1. Order
   An order can only be executed if the order form is duly and correctly completed by the one who orders.
   
   
2. Data protection
   Data made known to us and stored by us for the handling and execution of an order will be treated confidentially according to the legal regulations. For credit checks we reserve the right to exchange data with credit check institutions.
   
   
3. Prices, delivery expenses
   The prices given on the website are valid when ordering per Internet. The prices are valid as of the day of the order. In addition to the price of the goods we also charge delivery and packing expenses. 10% of VAT is added to invoice amounts for deliveries within Austria or to private persons within the European Union.
   
   
4. Payment
   First-time clients (up to 3 orders) have to effect payment exclusively by credit card or direct debit with the modules in our shop.
   From the third successful order and completed delivery onwards clients have the opportunity to effect payment via invoice. This option is only offered to clients in Austria.
   As a cost-saving alternative, direct debit is offered to our Austrian and also to our German clients.
   
   
5. Retention of title
   Konditorei Klaus Hanauer retains the sole und unrestricted title to delivered goods until they are fully paid with the inclusion of all arising fees.
   
   
6. Place of fulfilment, liability, maturity
   Konditorei Hanauer fulfils its contract duties by delivering the goods to the address given by the purchaser. Place of fulfilment is Vienna. Liability and maturity of payment start with the transfer of the goods to the transport company. Konditorei Klaus Hanauer reserves the right to choose the transport company.
   
   
7. Shipment as far as possible
   The contract only obliges Konditorei Klaus Hanauer to effect shipment as far as possible. In cases of force majeure, labour disputes, operational restrictions, traffic hold-ups or other difficulties in delivery Konditorei Klaus Hanauer is authorized to cancel or partially cancel the contract of purchase.
   
   
8. Defects
   Occurring defects in the delivered goods are to be reported the latest five days after receipt of the goods. Otherwise any claims for guarantee or damages are lost. Konditorei Klaus Hanauer does not assume liability whatsoever for petty negligence.
   
   
9. Disclaimer
   While we put together our website and the descriptions and prices it contains with utmost care, we cannot assume liability for possible misprints, technical changes on the goods or for the sustained deliverability of all goods.
   
   
10. Place of jurisdiction
    Exclusive place of jurisdiction for disputes arising from and in connection with the contract of purchase, also on its existence and its completion, is Vienna. Konditorei Klaus Hanauer has the right to file a suit against the purchaser at the court locally and factually responsible.
    
    
11. Applicable law
    Solely Austrian substantive law without recourse to the UN Right of Purchase has to be applied. Note: Orders can only be effected by persons who have completed their 18th year.
